The man who tried DeLay is Ronnie Earle, the Travis County prosecutor. Austin, TX is in Travis County. Delay was not successful in getting the trial moved to his home county.
Senior Judge Pat Priest had ruled that appropriate safeguards could be taken to give the Republican a fair trial in Democratic-leaning Travis County.
DaLay also suggested he trial was "political" and the laws of the state of Texas were not violated. A state's rights argument won't protect a criminal from 'money laundering" which is a federal crime.
Illegally moving political money across state lines is a federal crime like wire fraud.
