Dick DeGuerin, his attorney, said in an interview from his Houston office that he is confident that DeLay will never spend a day in prison. DeGuerin said:
I believe we will win the appeal, I believe his name will be cleared," DeGuerin said.
Of course, DeGuerin though Delay wouldn't be convicted in the recent trial, but he was.
Dalay complained recently he was convicted in the most liberal county in Texas. Apparently the justice system varies in Texas varies depending on county politics.
Matt Lauer interviewed Tom DeLay today on the NBC today show. Delay whined about his three year conviction for money laundering:
"I was convicted in the most liberal county of Texas. "
The man who tried DeLay is Ronnie Earle, the Travis County prosecutor. Austin, TX is in Travis County. Delay was not successful in getting the trial moved to his home county.
Senior Judge Pat Priest had ruled that appropriate safeguards could be taken to give the Republican a fair trial in Democratic-leaning Travis County.
DaLay also suggested he trial was "political" and the laws of the state of Texas were not violated. A state's rights argument won't protect a criminal from 'money laundering" which is a federal crime.
Illegally moving political money across state lines is a federal crime like wire fraud.

Is Tom DeLay the latest conservative martyr?
Tom DeLay was sentenced for three years for illegally directing corporate money to Texas candidates in 2002.
Tom DeLay, was sentenced today to three years in prison on his conviction for by-passing political funding laws as speaker of the House to forward his own electoral interests in Texas.
DeLay remains a free man, released on $10,000 bail pending appeal. But his sentence runs to five years in prison, reduced to three years with the addition of 10 years on probation.
DaLay insisted on his innocence, saying his prosecution as a political vendetta against him.
He told the judge, Pat Priest, who sentenced him: "Judge, I can't be remorseful for something I don't think I did. I fought the fight, ran the race and kept the faith."
As speaker DeLay was known as the Hammer. He had a reputation within Congress of being ruthless in enforcing the line and for his unflinching loyalty to President Bush's conservative agenda.
Delay allegedly set up an RNC slush fund to pour money directly into the Texas congressional races. The preosecuting attorney is asking jurrors if they can set political diffrences aside to give Mr. Delay a fair trail. Delay was a Speaker of the House during the Bush adminstration.
Tom DeLay did another fine job in Dancing with the Stars. DeLay has fractures in both of his feet and would be best for his health if he is voted off. He is certainly not the worst dancer on the show.
DeLay is lucky to have Cheryl Burke as his partner. Burke has won the competition twice and finished second last season. Many people who are familiar with ballroom dancing suggested Burke and her partner Gilles Marini should have won the competition rather than have been the runners-up last season. Burke is probably the best choreographer on the show.
A lot of the writers missed the symbolism of the DeLay dance. DeLay was dressed in red and had an elephant on his back and Burke was dressed in blue and had a donkey on her skirt. The song "Why Can't We Be Friends' was really a political statement.
One of our male writers scoffs at people who think dance is gay. The lady dancers are probably the hottest women on television. This writer was into dance during the Disco Era and met a lot of women because he could dance. He even met the woman on the dance floor that he married. Whether you are straight or gay, dancing is good for what ails you.
Ballroom dancing is one of the most strenuous exercises on the level of swimming. But it is more fun because of the people you meet and the music. Of interest, many of the professional ball room dancers are Eastern European. Ballroom dancing is also big in Russia.
At one time many Republicans and Democrats were friends. The political parties became heavily polarized during the Clinton presidency due to the leadership of Speaker of the House, Newt Gingrich. Gingrich, a very authoritarian speaker, insisted that the Republican House members should not associate with Democrats.
It would be nice if the the members of the two parties could be friends again. Even if the people in the to parties agree to disagree, there are always common areas in which the two parties can work together.
When Orly Taitz produced the fake Kenyan birt certificate, it produced a death gasp among Birthers. Ton DeLay tried to resuscitate the Birther corpse, but it was too late.
The Republicans sent investigators to both Honolulu and to Kenya with the purpose of disqualifying Obama from the presidency. They were not successful.
In the US you are innocent until proven guilty. Obama is under no obligation to produce his long form birth certificate to prove his innocence. His innocence is assumed under US law.
