Army LTC keeps tilting at birther windmills

Washington, D.C., June 9, 2010. Saying that the Army has made it “impossible for me to present a defense” at the Article 32 “preliminary hearing” previously scheduled for June 11, 2010, Lt. Colonel Terrence Lakin has officially waived -cancelled–that proceeding. 

An Article 32 hearing is a proceeding under the United States Uniform Code of Military Justice, similar to that of a preliminary hearing or grand jury investigation in civilian law.

Its name is derived from UCMJ section VII ("Trial Procedure") Article 32 (10 U.S.C. § 832), which mandates the hearing. Undoubtedly after LTC Lakin is convicted, he will become a Tea-Party and birther martyr.

The UCMJ specifies several different levels of formality with which infractions can be dealt. The most serious is a general court martial. An article 32 hearing is required before a defendant can be referred to a general court martial,

Therefore, the case will move inexorably on to a General Court Martial. The punishment for the charges filed against LTC Lakin carry a maximum term of four years in the penitentiary. As a convicted felon, LTC lakin could also lose his medical license.

Lakin expects the trial to be held in the early fall, but this has yet to be determined. The next step will be the formal referral of the charges by Lakin’s Commanding General, Major General Carla Hawley-Bowland, followed by his arraignment before a Military Judge, both of which are expected before the end of June.

Lakin, through his legal defense team, requested the testimony of Dr. Chiyome Fukino of the Hawaii Dept. of Health, and all of that agency’s records that exist concerning the president’s birth.

Lakin had also requested the testimony of the custodians of records of, and the records relating to Obama’s admission and financial aid that exist, of the Punahou School, Occidental College, Columbia University and Harvard Law School.

All these requests were also summarily denied, leaving Lakin without any perceived ability to mount a defense at the hearing. However, in that this hearing was preliminary in nature in the first place, Lakin will renew his requests to the Military Judge at the appropriate time.

Rightardia hopes this Army fool gets four years in a penitentiary. The Army needs to make an example of him to prevent other right wing morons from traveling down the same path.  Many conservatives have trouble understanding US laws, but they do understand punishment.

How the Birthers will react to the LTC Lakin's courts-martial

I'll bet the birth certificate "issue" is never even mentioned, because it is irrelevant. Birthers, of course, will claim victory any way the court martial comes out.

If Lakin is charged with desertion during wartime and executed, or if he is imprisoned for five years, the Birthers will claim he was silenced.

If Lakin is given an administrative discharge, the Birthers will claim that the government is hiding "something."

If Lakin has a trial but is not given personal access to Obama's "original long-form vaulted birth certificate", the Birthers will claim that Obama spent $ big bucks keeping that confidential record private.

If Lakin is given another chance to drop his case and to deploy, the Birthers will claim he has been brainwashed.

If Lakin is killed, kills himself, or disappears before, during, or after the trial... well, the Birthers will make that part of the grand conspiracy to install a Kenyan Marxist into the Presidency... A conspiracy that apparently began in the 1950s, and has the most people in the loop of any government conspiracy ever... 

Rightardia wonders how many more right wing officers will throw their careers away for the Birther movement. If Lakin is executed, Rightardia will nominate him for a Darwin Award.

What has Orly Taitz been doing lately?

Judge Carter’s shameless 180 degrees turn from his assurances at July 13 and September 8 hearings that his court has jurisdiction is not the end, it is only a temporary impediment and fighting it is only one of the first steps in reclaiming America and cleaning up all of this massive corruption and treason. Here are some of the steps I will be taking shortly:

1. On Monday 2 Appellate briefs are going to the 11th circuit court of appeals in GA on 2 cases I handled there

2. Notice of appeal in Carter case will be sent within 1 week.

3. There will be an action in DC

4. there will be a massive campaign under FOIA

5. there will be demonstrations and protests

6. there will be actions in International Courts to expose the violation of Human rights by Obama regime, the tyranny of the Communist Kenyan usurper Barack Hussein Obama and ones who are aiding and abetting him. I retained Mr. Jon Levy, who is licensed in a number of courts, including CA, DC, Great Britain and criminal court of Justice in Hague.

Great thanks to Mr. Frank Mannarino who helped in processing some 230,000 e-mails to get the e-mail addresses, which together with nearly 30,000 addresses of media outlets will make outreach possible. Rightardia comment: Orly Taitz has lost in three Federal courts and Judge David O. Carter advised her the courts have no jurisdiction to remove a standing president. She did not mention in her post that the State of California is trying to disbar her.

Taitz is trying to use the FOIA request to get information on Obama's mother, Stanley Ann Dunham, that would indicate Obama was born outside the US. The FBI indicated it was unable to find any main file records on Ann Dunham or that the FBI can confirm or deny that it had any person on its watch list.

Orly Taitz plans some sort of International Court action. This would have be a new initiative that does not relate to the Birther movement. Rightardia can only imagine someone like Taitz showing up in the Hague with her ludicrous arguments. She will be the laughing stock of Europe.

Eventually the public will tire of her and the Birther movement will backfire on the GOP.  Hopefully that time will be sooner than later.

Sarah Palin : The Queen of the Run On Sentence talks about Birthers

 

Is Obama's birth a legitimate issue? No, Obama was called out on it during the primary election and the State of Hawaii verified that both the long and short form of his birth certificate were in order. Snopes.com even found announcements of his birth in two Hawaii newspapers.


Orly Taitz brought suit in three courts and failed to convince any the judges that the Obama birth is a legitimate issue. She now has to pay a $20,000 fine in one of the federal courts and faces disbarment in California. 


Even if Obama was foregn born, he could only be removed form office by impeachment. With a Democratic House and Senate, this would be impossible. Intrade gives the GOP a 36 per cent probability of recovering the US House in 2010. 


All the Birther issue really does in make the GOP rank and file look small and mean spirited. Palin would have been smarter to say the GOP needs to concentrate on the real issues facing Americans today. No one but extreme right wing nuts care about the Birther issue.


HUMPHRIES: Sarah Palin here on the Rusty Humphries Show. One of the questions Jason asks is would you make the birth certificate an issue if you ran?

PALIN: I think the public rightly is still making it an issue. I don’t have a problem with that. I don’t know if I would have to bother to make it an issue because I think there are enough members of the electorate that still want answers.
HUMPHRIES: Do you think it’s a fair question to be looking at?


PALIN: I think it’s a fair question just like I think past associations and past voting records. All of that is fair game. You know, I’ve got to tell you too, I think our campaign, the McCain-Palin campaign didn’t do a good enough job in that area. We didn’t call out Obama and some of his associates on their records and what their beliefs were, and perhaps what their future plans were, and I don’t think that was fair to voters to not have done our job as candidates and a campaign to bring to light a lot of things that now we’re seeing manifest in the administration.

HUMPHRIES: I mean, truly if your past is fair game and your kids are fair game, certainly Obama’s past should be. I mean, we want to treat men and women equally, right?

PALIN: Hey, you know, that’s a great point. And that weird conspiracy theory freaky thing that people talk about that Trig isn’t my real son, and a lot of people that went "Well, you need to produce his birth certificate, you need to prove that he’s your kid," which we have done,  but yeah, so maybe we can reverse that, and use the same [inaudible] thinking on the other one.

MSNBC president Phil Griffin calls Birthers racist

UPDATE 2:30 PM, July 25 MSNBC president Phil Griffin called the claim that President Obama is a foreigner, which has received significant media coverage over the last few days, "racist."

From the NY Times: It's racist, said Phil Griffin, the president of MSNBC.  Just call it for what it is.

Mr. Griffin said the cable news coverage was set off by two back-to-back events: the introduction of a bill that would require presidential candidates to provide a copy of their original birth certificate (it has nine co-sponsors in the House and one in the Senate) and the video of a town hall held by a Republican Congressman that turned into a hearing on Mr. Obama's citizenship.

Rightardia believes the Birther movement is made up of many Tea Baggers who are racist. The Birthers are fundamentally saying they don't recognize Obama as the president of the US.

It is a mean spirited attempt to undermine President Obama's legitimacy. Obama won the election by nearly 8 million votes and had a 2:1 advantage in the Electoral College. His US citizenship has been confirmed by the state of Hawaii, FactCheck.org, Snopes.com and CNN.
